These Terms and Conditions (the “Terms”) govern your use of the Bunchups platform (the “Platform”), including our website and mobile applications. By accessing, registering for, or using Bunchups in any manner, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Platform.
Definitions
- “Bunchups” (the “Company,” “we,” “us,” or “our”) refers to Bunchups Pty Ltd, the operator of the Platform.
- “Platform” means any website, mobile application, or service offered by Bunchups, including all functionalities for browsing, creating, joining, and communicating about activities.
- “Account” means a registered user account on Bunchups, created by you for the purpose of using the Platform.
- “User,” “you,” or “your” means any person using the Platform. If you create an Account on behalf of an organisation or group, “you” also refers to that organisation or group, and you represent that you have the authority to bind it to these Terms.
- “Bunchup” (noun) means any event, meetup, activity or gathering (in-person or virtual) organised through the Platform by a Planner and attended by Participants.
- “Planner” or “Host” means the user who creates or plans a Bunchup. A Planner is responsible for scheduling the bunchup and providing accurate details.
- “Participant” or “Guest” means a user who joins or attends a Bunchup planned by another user.
- “Subscription” means a paid membership or Premium plan (weekly, monthly, or annual) that unlocks additional features on the Platform. We may call this “Premium Membership.”
- “Content” means any text, images, videos, audio, messages, or other material posted, submitted or otherwise made available by you on the Platform.
- “Community Guidelines” refers to any rules or codes of conduct Bunchups publishes governing user behaviour and content (for example, anti-harassment or safety guidelines).
Planner/Host Responsibilities
If you organise or host a Bunchup, you are solely responsible for ensuring that your event complies with all applicable laws, regulations, and venue requirements. You are responsible for obtaining any necessary permits, licenses, or insurance and for the safety and conduct of your event. Bunchups does not supervise, endorse, or control the quality, safety, legality, or suitability of any Bunchup or location.
Planners/Hosts must provide accurate and complete information about their Bunchups and promptly update participants of any changes or cancellations.
Acceptance of Terms
By creating an Account, accessing or using the Platform, you acknowledge that you have read, understood, and agree to abide by these Terms and all policies referenced herein. These Terms, together with our Privacy Policy and any other posted rules (such as Community Guidelines), form the entire agreement between you and Bunchups governing your use of the Platform. Bunchups may update or modify these Terms at any time. If we make a material change, we will provide notice (for example, by email or prominent posting) and update the “Last updated” date. By continuing to use the Platform after such changes, you agree to the revised Terms. If you do not wish to accept the revised Terms, you must stop using the Platform.
Bunchups reserves the right to modify, suspend, or discontinue any aspect of the Platform or services at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuance of the Platform or any part thereof.

Eligibility and Verification
You must be at least 18 years old (or the age of majority in your jurisdiction) to use Bunchups. By creating an Account, you represent and warrant that you meet this age requirement and that you have full authority to enter into this Agreement. You agree to provide true, accurate, and complete information when creating your Account and to keep it updated. Bunchups may require you to verify your identity, including by providing a valid phone number and a selfie or other photo for identity verification. This is to ensure the safety and authenticity of users. If you fail to complete verification, Bunchups may suspend or deactivate your Account.
Accounts are individual and personal. You may not use another person’s Account or share your Account with anyone else. Impersonation or false representation (e.g. using a fake name or photo) is strictly prohibited. You must keep your login credentials confidential. You are solely responsible for all activity that occurs through your Account. If you suspect unauthorised use of your Account, notify us immediately.
Bunchups reserves the right to deny access or refuse to provide services to anyone at its sole discretion, including if you do not meet the eligibility criteria or if you engage in misconduct. We may suspend or terminate Accounts of users we believe to be in violation of these Terms, or if we have reason to believe a user is underage.
Children’s Privacy
The Platform is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that a child under 18 has provided us with personal information, we will take steps to delete such information and terminate the account.
Account Responsibilities and Privacy
- Account Security: You are responsible for maintaining the confidentiality of your Account and password. You agree to accept responsibility for all activities that occur under your Account. You must notify Bunchups immediately of any breach of security or unauthorised use of your Account. You agree not to transfer or assign your Account to any other party or permit it to be used by others.
- Personal Information: You consent to Bunchups collecting and using your personal information as described in our Privacy Policy. This includes using your phone number and photo for verification. You should provide only information about yourself. Posting personal contact information (such as home address, personal email or phone) in public areas of the Platform is discouraged. If you choose to share personal information with other users (for example, via private messages), you do so at your own risk. We recommend using caution and common sense when interacting with others.
- Account Accuracy: You must ensure that all information you provide (including your name, photo, location, and description) is accurate and up to date. False information, especially regarding your identity, age, qualifications or intentions, is not allowed. Planners should provide accurate details about Bunchups (time, place, activities, fees, etc.) and Participants should provide honest RSVP information.
- Single Account: You may not create multiple Accounts without Bunchups’s permission. Duplicate Accounts, sockpuppets or fake accounts are prohibited. If Bunchups detects that you have multiple accounts or are attempting to manipulate the system, we may suspend or delete all related accounts.
- Account Termination and Data Retention: Bunchups may terminate or suspend your Account at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to the Platform or other users. Upon termination, your right to use the Platform will immediately cease.
We may retain certain information as required by law or for legitimate business purposes, even after your account is deleted or terminated, in accordance with our Privacy Policy.
Subscriptions and Billing
- Freemium Model: Bunchups operates on a freemium model. Basic use of the Platform (including browsing and joining certain Bunchups) may be free. We also offer Premium subscriptions (weekly, monthly, or annual) that unlock enhanced features (such as advanced search, unlimited messaging, or special badges). All fees are denominated in Australian dollars (AUD) and are charged through the payment method you select.
- Payment and Renewal: When you purchase a Subscription, you authorise Bunchups (or our payment processor) to charge your chosen payment method (e.g. credit card, PayPal, or the applicable mobile app store) for the subscription fee. Subscriptions automatically renew at the end of each term, at Bunchups’s then-current price, unless you cancel before the renewal date. Bunchups will notify you of any change in pricing prior to renewal. To avoid charges for a new period, you must cancel your subscription before the end of the current period.
- Cancellation: You may cancel your Subscription at any time. Cancellation will take effect at the end of the current billing period, and you will not be charged for subsequent periods. Note that deleting your Account or uninstalling the app does not automatically cancel your paid Subscription. If you purchased through a third-party store (Apple App Store, Google Play, etc.), you must cancel through that store’s interface. If you purchased directly through Bunchups, you may cancel via your Account settings or by contacting customer support.
- Refunds: All Subscription fees are non-refundable, except as required by law. If Bunchups terminates your Subscription (for example, due to a violation of these Terms), no refunds will be given for unused time. If you believe there has been an error in billing, contact us promptly. We will comply with Australian Consumer Law (ACL) regarding any statutory rights you may have, such as rights to a refund for services not provided or breaches of guarantee.
- Taxes: You are responsible for all taxes, duties, and other governmental charges associated with your purchases, except for taxes based on Bunchups’s net income.
Content Standards and User Conduct
Bunchups is a community for organising and attending activities; respectful and lawful behaviour is expected of all users. The following standards apply to all user Content and interactions on the Platform:
- Lawfulness and Respect: You must not post or engage in content or behaviour that is unlawful, abusive, harassing, defamatory, obscene, hateful, threatening, or otherwise objectionable. This includes slurs, hate speech, physical threats, or anything that could harass or degrade others. We have a zero-tolerance policy for any form of sexual harassment, exploitation, or abuse, including any content or behaviour that sexualises minors or encourages non-consensual acts. Everyone must be treated with dignity and respect. Bullying, intimidation, stalking, or making unwanted advances is strictly prohibited.
- No Illegal or Dangerous Content: You may not use Bunchups for any illegal purpose. Users must not promote or facilitate activities that violate the law, such as selling drugs or firearms, inciting violence, or planning criminal activity. Content that encourages or glorifies dangerous or extremist organisations or ideologies is forbidden. Discussion of risky activities should be done responsibly and with appropriate disclaimers. Always follow local laws and public health guidelines. (For example, Bunchups encourages organisers and attendees to follow local regulations and official health guidelines when meeting in person.)
- No Commercial Solicitation: Bunchups is not a marketplace. You may not use Bunchups to advertise or solicit for any commercial purpose without our express permission. Unsolicited advertising, spam, multi-level marketing schemes, or other forms of solicitation are prohibited.
- Authenticity: You must represent yourself truthfully. Impersonation or misrepresentation of any person or entity is not allowed. This includes creating an account with someone else’s name or photo or providing false information about your identity, background, or intentions. Planners should clearly describe themselves and their qualifications for planning a Bunchup. Do not copy or use anyone else’s content (images, text, etc.) without permission.
- Intellectual Property: Respect others’ intellectual property rights. Do not post content that infringes on copyrights, trademarks, or other proprietary rights. If you upload content to Bunchups, you represent that you have the right to do so. Users are responsible for their own content but grant the platform a license to use it. Likewise, do not use Bunchups’s branding, logo, or proprietary content without authorisation.
- No Malicious Content: You may not post viruses, malware, or any code or script intended to damage, disrupt, or gain unauthorised access to any computer, network, or data. Do not use Bunchups to send unsolicited mass messages (“spam”), phishing attempts, or harassing communications.
Bunchups reserves the right to remove or disable access to any Content that violates these standards or these Terms, without notice. Users who repeatedly post prohibited content or act improperly may have their Accounts suspended or terminated. You are responsible for all Content you post or send. As Peanut’s Terms note, “As Your Content is created by you, you are responsible and liable for Your Content and will indemnify… from any claims made in connection with Your Content”.
Additional Prohibited Activities
In addition to the standards above, you may not:
- Arrange or facilitate illegal, dangerous, or unauthorised activities.
- Solicit money or personal information from users for non-approved or fraudulent purposes.
- Use automated scripts or bots to access, collect data from, or interact with the Platform.
- Attempt to circumvent or interfere with the security or proper functioning of the Platform.
- Engage in any activity that could harm the reputation or operation of Bunchups.
Bunchups reserves the right to investigate and take appropriate action, including suspension or termination of accounts, removal of content, and cooperation with law enforcement.
Messaging and Safety
Bunchups provides private messaging and communication tools for users. All interactions should be polite and respectful. In addition to the Content standards above, the following rules apply to messaging and meeting others:
- Respect Boundaries: Contact other users only if you have a genuine purpose related to planning or attending a Bunchup. Unsolicited or harassing messages (including sexual or threatening messages) are not allowed. Always respect the boundaries and comfort levels of others. Consent is required for any personal or romantic advances; if someone is not interested, do not persist. (As dating apps emphasise, “Consent is required at all times” – unwanted sexual conduct is prohibited by law and will be treated seriously.)
- Privacy: Do not share sensitive personal information (home address, financial details, etc.) in public or unsecured communications. If you choose to share personal information privately (for example, arranging an off-platform meeting), you do so at your own risk. Bunchups encourage caution – never feel pressured to disclose more than you are comfortable with.
- Meetup Safety: If attending an in-person Bunchup, use common sense: consider meeting in public places, informing a friend or family member of your plans, and being mindful of your personal safety. Planners should ensure their events are safe and lawful venues. Bunchups does not control off-platform behaviour; each participant is responsible for their own safety. By using the Platform, you acknowledge and accept that participating in Bunchups, meeting other users, and attending events involve inherent risks, including but not limited to physical injury, illness, property damage, or loss. You agree that you voluntarily assume all such risks and that Bunchups is not responsible for the actions or omissions of any user, planner, or third party. You are solely responsible for your own safety and well-being when participating in any Bunchup or interacting with other users, whether online or offline. We recommend that you take reasonable precautions and exercise good judgment at all times.
- Reporting and Blocking: If another user behaves inappropriately or makes you feel unsafe, you may block or report that user through the Platform’s tools. Bunchups will review reports and take action as needed. For example, Bumble’s Terms note that when a user submits a report, support will review it and may issue warnings or bans, and importantly “will not tell the person who you reported that you reported them”. We encourage you to use these safety features; our moderators will investigate all reports according to our Community Guidelines.
Assumption of Risk and User Responsibility
By using the Platform, you acknowledge and accept that participating in Bunchups, meeting other users, and attending events involve inherent risks, including but not limited to physical injury, illness, property damage, or loss. You agree that you voluntarily assume all such risks and that Bunchups is not responsible for the actions or omissions of any user, planner, or third party.
You are solely responsible for your own safety and well-being when participating in any Bunchup or interacting with other users, whether online or offline. We recommend that you take reasonable precautions and exercise good judgment at all times.
Intellectual Property
- Bunchups IP: All content, technology, design, graphics, logos, and material provided by Bunchups (including the look and feel of the Platform) are owned by Bunchups or its licensors. You acquire no ownership rights in the Platform or any Bunchups content except for the limited license below. You agree not to copy, modify, transmit, distribute, reverse engineer, or create derivative works from the Bunchups software or materials without our permission. Any trademarks, service marks, and trade names on the Platform belong to Bunchups or third parties; you may not use them without authorisation.
- User Content License: By posting Content on Bunchups, you grant Bunchups a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, copy, modify, distribute, and display that Content for the purpose of operating, improving, and promoting the Platform. Your license allows Bunchups to store, share and showcase your Content as needed to provide the service (for instance, displaying activity details or photos to other users). This license survives the termination of your Account.
- Limitation of Liability and Disclaimer of Warranties: To the maximum extent permitted by law, Bunchups and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Platform; (b) any conduct or content of any user or third party on the Platform, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties; (c) any content obtained from the Platform; or (d) unauthorized access, use, or alteration of your transmissions or content.
The Platform is provided on an “as is” and “as available” basis. Bunchups makes no warranty or representation, express or implied, as to the reliability, accuracy, completeness, or timeliness of the Platform or any content. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Third-Party Materials: The Platform may contain links to or integrations with third-party content or services (e.g., maps, social media, payment processors). Any third-party content or services accessed through Bunchups are the responsibility of the parties providing them, and we are not liable for any issues arising from your use of third-party tools or sites. You must comply with any separate terms of use required by those third-party services.
Disclaimer of Warranties and Limitation of Liability
- No Warranties: Bunchups provides the Platform on an “as is” and “as available” basis. Except as expressly provided in these Terms or as required by law, Bunchups disclaims all warranties, whether express or implied. We make no guarantees regarding the reliability, accuracy, availability, or suitability of the Platform or any Bunchup. To the fullest extent permitted by law, Bunchups and its owners, officers, and affiliates disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- No Control of Real-World Events: You acknowledge that Bunchups merely facilitates connections between users. We have no control over the actions of Planners or Participants in real life. As Meetup aptly states: “Using our Platform involves meeting real people and doing real things in the real world… we can’t control what happens in the real world, and we are not responsible for it”. You agree that any participation in events found on Bunchups is at your own risk. Bunchups assumes no responsibility for any property damage, personal injury, or other losses suffered by you during a Bunchup.
- Limitation of Liability: To the maximum extent permitted by law, neither Bunchups nor any of its owners, affiliates or licensors will be liable for any direct, indirect, incidental, special, consequential or punitive damages arising out of or relating to your use of the Platform (even if advised of the possibility of such damages). Our total liability to you for any claim arising from these Terms or your use of the Platform will not exceed the amount you have paid us in the past 12 months (or, if higher, the minimum liability allowed by law). For example, Bumble’s Terms similarly state: “Neither we nor any owner will be liable for any damages, direct, indirect, incidental, consequential, special, or punitive”. Some jurisdictions (including certain consumer protection laws in Australia) do not allow the exclusion of certain liabilities; to the extent that we cannot disclaim liability, we will remain liable only to the extent required by law.
- No Professional Advice: The content on Bunchups is for informational and community purposes only. Bunchups is not a professional advisor. Any schedules, instructions or advice provided by other users are their own opinions. You should seek appropriate professional advice for legal, health, safety or other matters.
- You hereby release, discharge, and hold harmless Bunchups and its affiliates, officers, employees, and agents from any and all claims, demands, losses, liabilities, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with (a) your use of the Platform; (b) your interactions with other users; or (c) your participation in any Bunchup.
You agree to indemnify and hold harmless Bunchups and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Platform, your content, your violation of these Terms, or your violation of any rights of another.
Release and Indemnity
You hereby release, discharge, and hold harmless Bunchups and its affiliates, officers, employees, and agents from any and all claims, demands, losses, liabilities, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with (a) your use of the Platform; (b) your interactions with other users; or (c) your participation in any Bunchup.
You agree to indemnify and hold harmless Bunchups and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Platform, your content, your violation of these Terms, or your violation of any rights of another.
Indemnity and Risk Assumption
You agree to indemnify, defend, and hold harmless Bunchups, its officers, directors, employees and agents from any and all claims, liabilities, damages, losses and expenses (including legal fees) arising out of or related to: (a) your breach of these Terms; (b) your use of the Platform or participation in any Bunchup; (c) any Content you submit; (d) your violation of any law or the rights of a third party; or (e) any action you take at or related to an in-person Bunchup (including any illness or injury). In other words, you assume full responsibility for your participation in any event.
Example: As Meetup’s Terms note, you indemnify the company “to the full extent permitted by applicable law… from any Claims… arising out of (a) your violations of this Agreement, (b) your use of our Platform, (c) your Content…”. Bunchups adopts a similar clause. This means if you, as a Planner or Participant, cause harm or violation (e.g. by negligence at an event), you (not Bunchups) are responsible for any resulting claims. You also assume the inherent risks of meeting others. Participation in any Bunchup is voluntary, and you agree to accept any and all risks of personal injury or property damage.
Suspension and Termination
Bunchups reserves the right (at its sole discretion) to suspend or terminate your Account or access to the Platform at any time, with or without notice, for any reason or no reason, including but not limited to:
- Violation of these Terms or our Community Guidelines (e.g. harassment, illegal content, repeated abuse).
- Use of Bunchups for unauthorised commercial purposes.
- Actions that we deem harmful to other users or Bunchups’ reputation.
- Fraudulent or abusive behaviour.
If we suspend or terminate your Account, you may be barred from registering a new Account. Bunchups is not obligated to refund any prepaid fees upon termination for cause. In cases of termination for non-cause (e.g. we decide to discontinue the service), we will provide notice and refund any unused subscription fees for the remaining period. Example: Bumble’s Terms state that they “reserve the right at our sole discretion to terminate or suspend any Account… at any time without liability and without the need to give you prior notice”.
Upon termination, your right to use the Platform immediately ceases. All provisions that by their nature should survive termination (including intellectual property, warranty disclaimers, limitation of liability, indemnity, and governing law) will continue in full force.
Reporting, Blocking, and Moderation
Bunchups provides tools for users to block or report others. If you encounter inappropriate or unsafe content or behaviour, you should use these tools. Bunchups will investigate reports in accordance with our Community Guidelines and these Terms. Actions we may take include:
- Warnings: We may warn a user who violates our rules.
- Removal of Content: We may delete posts, photos, or messages that violate these Terms.
- Account Suspension/Ban: For serious or repeated violations, we may suspend or permanently ban the offending user.
We strive to protect user privacy. If you report someone, we will keep your identity confidential. When you submit a report, “a member of the support team will review it and take action… Bunchups will not disclose your identity when acting on your report, except as required by law.
Our moderation may be carried out by employees or automated systems. Bunchups does not guarantee that all prohibited content will be removed, but we will act reasonably to enforce these Terms. Users agree that Bunchups is not liable for any false claims or mistaken suspensions and that our discretion in moderating content and users is final unless governed by law. If you disagree with a moderation decision, you may contact us to appeal, but Bunchups is not obligated to reinstate content or accounts.
Third-Party Services and Cookies
- Third-Party Content: The Platform may use third-party services (such as map providers, payment processors, or identity verification services). These services are governed by their own terms and policies. Bunchups is not responsible for the operation or security of third-party services, and you agree to comply with the terms of those services (for example, Apple App Store or Google Play purchase rules).
- Cookies and Tracking: Bunchups and its partners use cookies and similar technologies to operate and enhance the Platform. For example, we and our partners use cookies to authenticate your session, remember preferences, analyse usage, and improve performance. By using Bunchups, you consent to the use of cookies and similar technologies as described in our Privacy Policy. You may control or disable cookies via your browser or device settings, but this may limit some functionality of the Platform.
Changes to the Service
Bunchups may modify, suspend, or discontinue any aspect of the Platform at any time, including content, features, and pricing. We will attempt to notify users of major changes (for instance, by posting updates or emailing active subscribers). However, Bunchups is not liable if the Platform is modified, interrupted, or discontinued. We are continually improving our Platform. This means that we may modify or discontinue portions of our Platform. You agree that Bunchups has no obligation to provide any particular feature and that we will not be liable for any loss or inconvenience resulting from changes to the service.
Force Majeure
Bunchups shall not be liable for any failure to perform or delay in performance of any obligation under these Terms if such failure or delay is caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government action, pandemics, or interruptions in internet or telecommunications services.
Governing Law and Jurisdiction
These Terms are governed by the laws of Australia. You and Bunchups agree to submit to the exclusive jurisdiction of the courts of the state or territory in which Bunchups is registered (for example, the courts of [State of Victoria], Australia), as well as the Federal courts of Australia, to resolve any dispute arising out of or related to these Terms. (A typical clause might read: “This Agreement is governed by the laws of Victoria, Australia and each Party irrevocably submits to the exclusive jurisdiction of the courts of Victoria”.) Notwithstanding this choice of law, nothing in these Terms is intended to limit any rights you may have under applicable consumer protection laws that cannot be contracted out of.
Dispute Resolution
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform, you agree to first attempt to resolve the dispute informally by contacting Bunchups support. If the dispute is not resolved within 30 days, either party may refer the matter to binding arbitration in accordance with the rules of the Australian Centre for International Commercial Arbitration (ACICA).
If you have any issues or disputes with Bunchups or another user, please contact us first at support@bunchups.com.au to seek a resolution. We will use reasonable efforts to resolve complaints amicably. Any dispute, controversy or claim arising out of or relating to these Terms or your use of the Platform will be resolved according to the governing law clause above.
Depending on local law, disputes may be resolved by negotiation, mediation, or arbitration. For example, some online services require binding arbitration instead of court litigation. If Bunchups implements an arbitration or other alternative dispute resolution process, we will provide you notice and the opportunity to opt-out if permitted. If arbitration applies, both you and Bunchups agree to waive any right to trial by jury or class action, and any award would be limited to individual damages. If arbitration is not chosen or is unenforceable, then either party may bring a claim in the agreed jurisdiction. Notwithstanding the above, either party may seek injunctive or equitable relief in a court of law if needed (for example, to prevent unauthorised use of intellectual property).
Severability and Waiver
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. The failure of Bunchups to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
